Terms of Service

These Terms of Service ("Terms") apply to crkd.ca (the "Site"), to purchases from the CRKD shop, and to design work commissioned from CRKD*arthouse. CRKD and CRKD*arthouse are operated by David Mackay in British Columbia, Canada ("CRKD", "we", "us", "our"). By using the Site, placing an order or starting a project with us, you agree to these Terms. If you do not agree, please do not use the Site.

1. Using the Site

You must be at least the age of majority where you live, or have a parent or guardian's permission, to place an order or start a project. You agree not to use the Site for anything unlawful, to interfere with how it works, to scrape or copy it in bulk, or to submit false information.

2. Shop orders

CRKD releases are produced in limited quantities. Product images and descriptions are as accurate as we can make them, but colours and fit can vary slightly between screens and production runs. Prices are shown at checkout, including the currency, and may change without notice before an order is placed. We may refuse or cancel an order, for example when an item is out of stock, a price was shown in error, or an order looks fraudulent. If we cancel a paid order, you will be refunded in full.

Payment is taken at checkout through Shopify's payment providers. We do not store your card details.

3. Shipping, returns and refunds

Shipping is covered by our Shipping Policy. Returns, exchanges and refunds are covered by our Refund Policy. Both form part of these Terms.

4. Design services (CRKD*arthouse)

Briefs and quotes. Projects start with a brief, submitted through the Start a Project page or by email. We reply with the scope, timeline and a quote. A quote is valid for 30 days.

Deposit and payment. Work begins once the brief is agreed and a 50% deposit is paid, unless we agree otherwise in writing. The deposit is non-refundable once work has started. The remaining 50% is due on completion, before final files are released.

Rush work. Turnarounds faster than our standard timeline carry a 40% rush fee, quoted before work begins.

Revisions. Each project includes the rounds of revisions set out in its quote. Changes beyond that, or changes to the agreed scope, are quoted separately before we do them.

Timelines. Timelines depend on receiving your feedback, content and approvals on time. If a project is paused by the client for more than 30 days, we may close it and invoice for the work completed.

Your materials. You confirm that you own or have permission to use anything you send us, including logos, photos, references and copy, and that using them in your project will not infringe anyone else's rights.

Ownership and licensing. Once the full balance is paid, you own the final approved design files delivered for your project and may use them for your business. Concepts, sketches and drafts that were not selected stay with CRKD. Fonts, stock images and other third-party assets remain under their own licences.

Portfolio use. We may show finished work in our portfolio and on social media unless you ask us in writing not to before the project starts.

Cancelling a project. Either side may end a project in writing. You pay for the work completed up to that point, and the deposit is kept. Final files are only released once everything owed is paid.

5. Our content

Everything on the Site, including the CRKD and CRKD*arthouse names and marks, designs, artwork, photos, video and text, belongs to CRKD or is used with permission. You may share links to the Site, but you may not copy, sell or reuse its content without our written permission.

6. Content you send us

If you send us comments, messages or other content, you give us permission to use it to respond to you and to run our business. Please do not send anything unlawful, offensive or confidential that you do not want us to read.

7. Third-party links and services

The Site may link to other websites and uses third-party services such as Shopify and payment providers. We are not responsible for their content or practices, and their own terms apply.

8. Disclaimer

The Site and its content are provided as is. We work to keep the Site accurate and available, but we do not promise it will always be error-free or uninterrupted.

9. Limitation of liability

To the extent the law allows, CRKD is not liable for indirect or consequential losses, such as lost profits or lost data, arising from your use of the Site, our products or our services. Our total liability for any claim is limited to the amount you paid us for the order or project the claim relates to. Nothing in these Terms limits any rights you have under consumer protection law.

10. Indemnity

You agree to cover any loss or cost we face because of a claim arising from your breach of these Terms or from materials you supplied for a project.

11. Privacy

How we collect and use personal information is set out in our Privacy Policy.

12. Governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there.

13. Changes

We may update these Terms from time to time. The date at the top shows when they last changed. Changes do not affect orders already placed or projects already underway.
